Can an applicant question the way their request has been handled?
Yes, the Scottish Act gives the applicant the right to ask the practice to review its actions and decisions in relation to the request. This is called a requirement for review. The requirement for review must: (i) be in writing and usually within 40 days. (ii) state the name of the applicant and an address for correspondence (iii) specify the request for information which the requirement for review relates (iv) state the reason for dissatisfaction. Practices must respond to a requirement for review promptly and within 20 days of receipt.
