Can a US company request a worker to come back the following year?
Yes. Workers can return for consecutive year but in some circumstances may need to remain in their home country for up to 6 months before reapplying for another H-2B visa. Once a worker has obtained an H-2B visa and returned home upon expiration, it may be easier to get a second H-2B visa because the worker has demonstrated that he/ she will adhere to US law requiring proof of residence abroad that they are not abandoning their country to live permanently in the U.S.
