Can a smoke spillage test pass if flue is partly blocked?

we had a problem where by the smoke spillage test passed but we were still getting fumes from the gas fire usually when it was windy,it took a year to get anything done, I resorted to involving corgi & eventually it was sorted, the problem wasn’t a blockage but a hole in the chimney breast at the back of the fire which should have been sealed, don’t assume that because the fitter that you are paying to do the job is registered that he is going to do the job properly we paid £4,500 & it could have killed us.
