Can a provider hire an employee or accept the services of a volunteer prior to receiving a determination from OMH?
No. A provider cannot hire an employee or approve an applicant for volunteer service that includes regular and substantial unsupervised or unrestricted physical contact with the clients prior to BCHI rendering a determination on the applicants suitability for employment or volunteer service in that position. However, providers may “Temporarily Approve” an applicant once he or she has been physically fingerprinted, provided this is done in accordance with OMH regulations at 14 NYCRR Part 550.
