Can a petition be withdrawn after filing an application?

0

Yes. However, if the Public Hearing has been advertised and abutters notified, a Public Hearing on the request for withdrawal of the Special Permit application will take place. If the Board of Aldermen approves a request to withdraw the application without prejudice, a similar Special Permit application may be filed within 2 years of the filing of the original Special Permit application. If the request to withdraw is not granted and the Board of Aldermen denies the application, then a similar Special Permit application cannot be filed during the 2-year waiting period unless both the Board of Aldermen and the Planning Board find that the new Special Permit application is substantially different from the original application.
