Can a person have a Legal Representative at the Magistrates Inquiry?
Yes. The law says that you can be represented by a lawyer, or if the Magistrate agrees, someone that you choose. You can also choose not to be represented. You have the right to legal representation at all stages of application of the Mental Health Act Usually the Mental Health Advocacy Service will send a lawyer to see you a day or two before the Inquiry. This service is free of charge.
