Can a paraplegic be convicted of rape?
Hehe…it’s funny how closed-minded some people are. A paraplegic has, by definition, two limbs that are limited in mobility to the point of being deemed inoperable. These may be legs, arms, or a combination (though unusual). Rape, in most, states is not confined to vaginal pentration by a penis. It can also be mouth to genital or “object” rape (ie. insertion of of a foreign object). So yes, it is quite possible. A paraplegic with two immobile arms could use his/her mouth, for example, or a sleeping, drugged or somehow otherwise subdued victim. A paraplegic with leg issues could use his/her mouth or a foreign object. (I suppose you could insert a foreign object with your feet too, now that I think of it).
In a sense, yes. If his/her genitals are still working, then yes, definitely (unless the attacker is female, in which case the charge would be Causing Sexual Activity Without Consent, which the Home Office has made clear is a charge that enables a woman to be locked up for forcing a man into sex). A man could also be charged with Causing Sexual Activity Without Consent. If there is penetration, regardless of the sex of the attacker, the sentence is life imprisonment. If the paraplegic used an object for penetration, they could be convicted of Assault by Penetration, which also carries a life sentence. That information is based on the U.K.. In some U.S. States, ‘rape’ is used in law to refer to non-consensual sexual activity that is not penetrative. In some countries, there are beliefs (about what constitutes rape) that are far more ridiculous than the myths believed by some people in the U.K. – for example, people in other countries may wrongly believe that a man can’t rape his wife, o
