Yes. Section 35.49(b) allows sealed sources or devices for medical use to be non-commercially transferred from a Part 35 licensee to another Part 35 licensee. Prior to transfer, the medical licensee receiving the sealed source or device must be authorized on its license to possess and use the device in accordance with applicable sections of Part 35 for which the sealed source or device will be used. See 10 CFR 30.3 and 35.1. Refer to Supplementary Information, Section III, Summary of Public Comments and Responses to Comments for 35.49, as published in the Federal Register on April 24, 2002.
