Can a Lender Sue a Borrower for a Deficiency Judgment if the Lender is Still Owed Money After a Foreclosure Sale in North Dakota?
There is no right to sue a borrower for a deficiency judgment if the property at issue is a single family dwelling or a multi family dwelling with fewer than four units and the property is less than 40 acres in size. Commercial or agricultural properties that are larger than 40 acres may be subject to a deficiency judgment.
