Can a lecturer record sports programmes off Sky Sports, edit them and then use the edited highlights in lessons? Is this allowed under copyright law?
Yes. Under s.35 of the Copyright, Designs and Patents Act 1988 (as amended) educational establishments are permitted to make a recording of a broadcast for the non commercial educational purposes of that establishment without infringing copyright. At present it appears that SKY TV broadcast material is not part of a broadcasting licence scheme and so the provisions of the Act will apply.
