Here’s how this works: If a minor is getting abused or is in physical danger, then the officer would file for the restraining order (protection order) on behalf of the child. If the parents are not the suspects then they would have to file for the order with the child. If your state uses a magistrate, the parents would bring the child with them to the magistrate’s office. If the officer is taking out the order, the officer just takes a statement from the child, but goes to the magistrate alone. The child, could not file for the order by him/herself.
