By legal definition, an exchange visitor is “an alien having residence in a foreign country which he/she has no intention of abandoning, who is a bona fide student, teacher, professor, research scholar, specialist, or leader in a field of specialized knowledge or skill who is coming temporarily as a participant in a designated exchange program”. Thus, a J-1 can not have an intention to remain in the United States indefinitely.
