Can a home be sold without the consent of a spouse who has abandoned the home/marriage?
Spouse left home in May of 2008 and stopped paying the mortgage. I intend to sell the home and pay off our current mortgage/debts and then split the amount between us 50/50. Due to his abandonment, can I legally sell the house w/o his involvement? He is a fool to let this house go into foreclosure with the huge amount of equity that is in our home. He has lots of problems and may be facing a jail term soon. I have an injured child and I am just trying to survive. Any input would be greatly appreciated.
