Can a flat fee of $20 be charged instead of $20 per hour for clerks services?

Yes. AOC has reviewed the language in subsection (9) of SB 5277 and believes it is a reasonable interpretation of the “portion of an hour” statement that allows the courts to charge a minimum of $20 for a service, even if it takes less than an hour to complete. Therefore a flat fee of $20 can be charged for any tasks outlined in this subsection.
