Can a Dr. be legally sued or possibly penalized for not sterilizing medical instruments?
1- Yes, he can get in trouble. The Doctor is required by law to follow all proper medical procedures, and if he willingly goes against procedure (with the knowledge that what he is doing is illegal), then yes he can be sued, and he can also be fired from his job and lose his license to practice medicine. If people are hurt from the incident, they can sue and he could even get a criminal charge. 2- YOU have no right to sue him for money, as you have not been treated by him- and therefore, you personally have not been negatively impacted or hurt by what he is doing. The suit would be laughed out of court, as you personally have no claim. However, if you wanted to bring a purely criminal suit against him (to make him lose his license and perhaps receive jailtime or a fine), you can go down to your local police department and report it anytime you wish.
