Can a cosigner sell a car that shes not making payments on?
It depends on how the contract is written up. If it’s registered as Mary OR Sally, Mary can sell it since she’s the primary signer and doesn’t need your approval. If it’s registered as Mary AND Sally, Mary cannot sell the car without your approval If it’s an OR rather than a AND, she can sell it. But she does need to repay you for every payment you made since you made them and you didn’t intiate the sale. She did. If she doesn’t or refuses to, there is one final avenue for you to pursue, Small Claims Court. If you have proof that you made all the payments and she made none, and she sold it without telling you about it, take that evidence and file in Small Claims Court for the full amount of your payments.
