Yes. The association can make all sorts of criteria. Where I live they are prohibited de facto becase section 8 tenents can’t live in a complex that has a swimming pool in my state. The better way to do it rather than explicitly say “section 8 tenents” would be to make a specific set of criteria that renters must meet (like make 2x what the rent is and pass a criminal and/or credit check…all data needing to be turned over to the association). My association requires copies of leases and copies of any background checks done, but I get around that by not having leases or background checks (which puts me at a higher risk, just so that I can preserve my privacy). So watch how you write the rules.
