No. The TRDP do not provide for an appeal from a unanimous dismissal by the grievance committee. I don’t think that the grievance committee handled the complaint properly. What can I do? BODA does not participate in or otherwise supervise the investigatory hearings. Any comments or complaints about the investigatory hearing should be sent to the State Bar Chief Disciplinary Counsel’s office. EVIDENTIARY APPEALS What is an evidentiary appeal? It is an appeal of the decision of a State Bar of Texas grievance committee evidentiary panel. After the investigatory panel meets and offers the attorney a sanction, the attorney may accept the sanction or may opt to go before an evidentiary panel of the same grievance committee. The attorney may also elect to have the matter heard in district court.
