Can a client arrange for any outside entity of choice to administer medication?
Yes. KRS 194A.705 is not limiting in stating that clients of an ALC may arrange for additional services under direct contract or arrangement with an outside agent, professional, provider or other individual so designated by the client, if permitted by the policies of the ALC. However, per the definition of health services in KRS 216B.015, any person providing clinically-related services to two or more people is required to be licensed as a private duty nurse, home health agency or another applicable health care provider. It is recommended that an ALC’s policy regarding a client’s right to arrange for additional services under direct contract or arrangement should stipulate the client is responsible for ensuring that any outside agent, professional, provider or other individual complies with this policy.
