Can a carrier offer a voluntary appeal process for denied variances or is that intended to be the “informal resolution” process?
Yes. The Board strongly encourages carriers and treating providers to resolve informally disputes involving the Medical Treatment Guidelines, including variance requests. For that reason, the Board has built in time to allow the parties to attempt to resolve the dispute informally before seeking adjudication by the Board. If the dispute is resolved by discussion, the carrier must submit to the provider and the Board a signed copy of the MG-2 form indicating the dispute has been resolved.
