YES, we have to interview people in all kinds of altered states of mind… however, i feel your question is would it be correct or hold up in court if that man was given his rights and could he remember them… the answer to that is again yes, he or she can wave there rights even if they are intoxicated… each person makes up there own mind on how this will be handled… However, the police cant give to people or alcohol in effort to get them to talk if that’s your question…
