As your friend has been living in Canada for 3 years and has not seen her children too often, a senseful judge/court may decide that the children stay with their father. In this case the Hague Convention says that the decision about the children must be made by a Philipine court and the children must not be brought out of Philipines before that decision. This does not mean that your friend and her husband can agree on ANYTHING (some or all children in Canada or Philipines) and then get it “signed” by a court decision. For the welfare of the children, this would be the best! I would urge your friend not to insist to have her kids but better to talk to her husband and agree on what is good for the children.
