The Second Amendment to the U.S. Constitution says “the right of the people to keep and bear arms shall not be infringed.” Gun ownership is a right, not a privilege. As a Libertarian Constitutional scholar, I am acutely aware of the differences between rights and privileges: privileges can be licensed, rights cannot. If government licenses an activity, that gives it the power to deny the license when it wants to. Government does not have the power to prohibit rights. I oppose licensing of guns and all government regulation of guns. “A well regulated militia, being necessary to the security of a free State,” is a declaratory clause, not a restrictive clause.
