He was charged on six counts of second-degree murder. In NY State the death penalty only applies to first-degree murder trials. From memory in the book High Hopes, Gerard Sullivan mentioned that even when in cases of first-degree murder one of several reasons the death penalty would only apply would be if the accused/defendant had murdered a police officer. I cannot remember the other exceptions where the death penalty applies. Sorry.
