At what point is a work considered to be fixed in tangible form?
A work is “fixed” if it can be “perceived, reproduced, or otherwise communicated for a period of more than transitory duration,” either directly or with the aid of a machine or device. Any form or medium of fixation will suffice, even one which can be expressed only by means of a machine that didn’t exist at the time the copyright statutes were enacted.
