As an employer or business owner/operator, what are my responsibilities to stop employees and patrons from smoking?
Employers and business owners/operators or any person in charge or control of the business are required to ensure that no smoking is permitted in places prohibited by this bylaw. All reasonable steps must be taken to prevent employees and patrons from smoking, including ensuring that no ashtrays are placed in areas where smoking is prohibited. Business owners/operators are expected to ask patrons to extinguish smoking materials, refuse service, and request that the patron leave the premises. In the event that the patron refuses to comply with a request to extinguish smoking materials or leave the premises, a complaint should be registered with Bylaw Enforcement at 799-8888. Proprietors are also required to ensure that signage is posted at all entrances and exits, washrooms and in any area where food or beverages are sold. This bylaw also applies to home based businesses, but not to any portion of the home that is used solely as a residence.
