A. Currently, Government Code Section 69957 allows the courts to use ER in misdemeanors, infractions, and limited civil when an official or pro tem is not available. If ER is being used contrary to this law, you should contact your union immediately. If you are not represented, contact COCRA. The law is on our side, and we should use it to restrict ER to where it is lawful. The answer is not to expand its use, as the CRPA does.
