Are we to include attorneys appointed to represent people for matters in JP Courts?
No. A person charged with a Class C misdemeanor (non-jailable offense) is not entitled to court appointed counsel even though an official may believe an attorney appointment is needed to facilitate the ends of justice. However, if the JP is acting as a magistrate for a Class B or above misdemeanor or any felony offense and has been designated by the county court at law or a district court to appoint counsel for an indigent defendant for either of these courts, then any resulting attorney fees are eligible.
