ARE WATER RIGHTS CONVEYED WITH REAL ESTATE?
If appurtenant to real property, water rights are automatically conveyed when the property is conveyed unless specifically reserved. However, only agricultural water rights and “water rights necessary for the enjoyment of the property” are appurtenant.
