Are wallcoverings covered under the new CPSIA act?
We sell home decorating products that may have a junvenile theme. They are sold through retailers who have affiliated them with other children’s theme products. For example, a Sponge Bob Wall Border is sold by the same department that sells Sponge Bob toys. The new CPSIA law affects children’s products. The CPSA site defines “children’s products” as designed or intended primarily for use by Children under 12. While our product is designed to decorate a child’s room, it is meant to be installed by an adult. Once installed, it is a room decoration. The CPSC site give one pertenant example, a wall haging or drapery is not considered a “children’s product’ and is, therefore, not intended for coverafe under the CPSIA. It is considered a normal household item.The same material made into a sheet or pillowcase is covered by the law because it is intended to be used by the child as bedding. Our product, the wallcovering, should be excluded as well. Is it?
