The Regime is applicable to the Federal Administration and its decentralised entities, including social security institutions. See Decree No. 1023/01, article 2. Decree No. 486/02 has temporarily excluded the National Institute of Social Services for Retired Persons and Pensioners from the Regime’s scope of application. The Oficina Nacional de Contrataciones is the body in charge of the Government Contracting System under the Regime, being empowered to, inter alia, establish contracting policies, issue complementary, explicatory or interpretative regulations, answer inquiries made by public entities and provide advice to bodies carrying out awarding procedures. However, this Office does not execute awarding procedures, which are implemented by each Government contracting body. In performing its functions, the Oficina Nacional de Contrataciones could well deliver its opinion on whether certain entity is covered by the Regime and, therefore, is required to abide by its rules.
