The newly written AZ State statute for shelter requirements for livestock states that, “shelter must be adequate for the welfare of the animal.” “Shelter” can be described differently, and can legally include tree lines, washes, overhangs, anything that can provide a degree of shelter or protection for the animal. “Adequate” is also a very vague term, open to interpretation. I agree with you, that horses are often housed in this area without benefit of cover…they’re exposed to sun, wind, rain, and that seems a shame. Unfortunately, being familiar with animal neglect investigations, it becomes very difficult to prove neglect if the animal has not suffered any ill effects from its situation.
