Are there exceptions to being included in the Settlement Class?

0

You are not a Settlement Class Member if you are owned directly or indirectly by any of the Defendants or by Owens Corning Corporation, even if you received a copy of the Notice. For example, if you transferred ownership of your claim in this lawsuit to one of the Defendants (such as Masco) or Owens Corning as part of the sale of your business, you are not a Settlement Class member. However, if you sold your business or assets to Owens Corning or one of the Defendants (such as Masco) but retained ownership of the claims being asserted in this lawsuit, then you are a member of the Settlement Class, provided that you fall within the definition of the Settlement Class described in Question 6 above. To obtain any of the benefits of the Settlements, you will have to submit proof that you own the claims being asserted in this lawsuit when you submit your Proof of Claim form. For more information regarding the Proof of Claim form, see Question 11 below.
