Are there eligibility restrictions for owners for an HSA?
There are no restrictions on business owners being able to open an HSA as long as they are eligible (covered under a high-deductible health plan). However, only W-2 employees are eligible for a cafeteria plan. Owners are restricted from making pretax HSA contributions through a cafeteria plan. They can make a post-tax contribution and claim an “above-the-line” deduction on their tax return.
