Are there circumstances under which an employee may request to receive paid vacation or compensatory time in conjunction with FMLA?
An employee may request and receive paid vacation or compensatory time. Granting of vacation or compensatory time is not subject to any other employer requirements such as seniority or staffing needs. However, the employee must attempt to schedule foreseeable qualifying leave so as not to unduly disrupt the employer’s operation. If the employee is unable to provide sufficient documentation to determine FMLA eligibility, the employee shall be placed on unpaid leave until such documentation is made available to the employer.
