Are there any provisions as regards the jurisdiction of courts in respect of joinder of parties?
O 1, r 3 assumes the existence of a suit in a proper forum, i.e. in the court that has the jurisdiction to try the suit. If the court has such a jurisdiction, then this rule may come into play. However if a suit is brought against 2 defendants A and B and the court has the jurisdiction against A alone, but none against B, this rule does not confer the jurisdiction upon the court to try the suit against B, merely on the fact that the conditions of this rule are satisfied.
