However, your facility runs the risk of being randomly inspected as a potentially non-compliant facility by the Texas Department of State Health Services (DSHS) or the U.S. Environmental Protection Agency (EPA), Region 6 (Dallas office), which could lead to assessment of penalties. Administrative penalty fines from DSHS can range as high as $20,000 (per facility) for failure to file the Tier Two Report and filing fee with DSHS and copies of the Tier Two Report with the local fired department and LEPC. However, evaluation of a facility’s compliance history could result in a considerable reduction of these fines. EPA’s fines are considerably more than those issued by DSHS.
