Licensed professionals under title 8 of the Education Law who contract with OMRDD (not a voluntary provider) and who do not have employees who have regular and substantial unsupervised or unrestricted physical contact with people with developmental disabilities do not need to be fingerprinted. If a contractor does not provide services that can be considered treatment, care, therapy or diagnostic services those employees are exempted. All other employees who have regular and substantial unsupervised or unrestricted physical contact with people with developmental disabilities must be checked through a request submitted by a registered provider, a voluntary agency or a DDSO.
