Are there any alternatives to jail or prison sentences?
Although most federal prosecutions result in incarceration, exceptions do rarely exist. Options for alternatives are available and courts generally consider these issues on a case by case basis. Courts will consider diversions through items brought up in the Pre-Sentence Investigation Report. It is imperative that a substantial amount of time is devoted to a comprehensive mitigation report (or sentencing memorandum) that is presented at sentencing.
