ARE THE PEOPLE WHO USED plea of insanity still in mental hospitals?
People who plea (or are found) guilty by reason of mental defect (also known as innocent by reason of insanity) are committed to mental hospitals for treatment. Their treatment is reviewed by medical professionals, and when they have been rehabilitated, they are released. This can mean if someone was “temporarily insane” then they are released in the matter of months. If they have significant long term mental issues, they can be in a facility for the rest of their lives. In many jurisdictions, the finding of mental defect is left to a jury, with the help of expert witnesses. This means the “genuine” determination of illness can be suspect.
