Are the Deed Restrictions enforceable and who is responsible for enforcing them?
Each homeowner, at closing, signed a document that said they would abide by the Deed Restrictions and they are enforceable in a court of law, at the homeowner’s expense for any legal fees that may be incurred in the enforcement process. The Board of Directors is responsible for enforcement of the Deed Restrictions and have hired a management company and an attorney to be the actual enforcers.
