Are social security numbers ever required for filing a financing statement?
UCC financing statements do not require a social security number or employer identification number (“EIN”). However, Effective Financing Statements (“EFS”) covering farm products require a debtor’s SSN or EIN to be indicated on the document. This requirement is mandated by the Federal Food Security Act of 1985. Regardless, SSNs and EINs are redacted from the publicly accessible images of EFS records. Furthermore, the Colorado Secretary of State’s Office has developed and gained approval for a unique identifier that will be used in substitution of a debtor’s SSN or EIN.
