Are short-term leases covered by the Act?
Short-term leases and subleases of 12 months or less (including any option to extend the lease or sublease) do not trigger disclosure requirements under the Act. All other lease arrangements are subject to the disclosure obligations in the Act. For example, a six month lease with an option to extend for another six months would not trigger the disclosure obligations because the total proposed lease term would be 12 months or less. However, a six month lease with an option to extend for 12 months would trigger the disclosure obligations because the total proposed lease term would be more than 12 months.
