Are politicians following the constitution or making the constitutiion?
Actually our Presidents have no Constitutional privlege to “make” the Constitution. As for interpreting the Constitution, again the President has no privleges there, either. That interpretation is to left up to the Supreme Court. Sad as it seems, this present administration has taken on the “right” to interpret the Constitution without any assistance from the Supreme Court. An impeachable offense if you ask me.
The Constitution is like a fixed target. Once you know it, the wording cannot change, except by Amendments, which Congress can’t acheive without some kind of support from the states. The Constitution is what empowers legislators to make Laws; Laws may not contradict the Constitution. The Constitution also empowers the President to issue Orders, which control the details of how the Laws are followed. The Supreme Court has the ultimate authority to determine what the Constitution means, but does that only rarely, and the Justices must treat it as they would any other Law. If you feel that politicians have not followed the Constitution, you have the right to sue them.
They are supposed to do both but in reality they are engaged in the latter while giving the former the royal go-by.Even in the matter of making laws they draft them in such a fashion as to allow themselves sufficient loopholes to wriggle out of dicey situations and interpretations.Hence the expression “delightfully vague”,Have a Great Day.
