Are Planet Design and PlanIt Architectural Design considered similar enough names to prevent Trade marking both ?
I am currently going through trademark process for my business brand (PlanIt Architectural Design) and have received and objection and request to discontinue with this application by another company called Planet Design, operating in similar fields in different areas of NZ. Admittedly they have used this name for longer (10 years) than I have used mine (5 years), and I was completely unaware of them till I received the letter from them 1 month ago. I am not in a position where I can afford to engage an expert to persue the application especially if I am likely to fail anyway. Our logos aren’t really that similar (or potentially confusing), so it really comes down to the name which to the uninitiated probably could be the same.
