The Florida Association of Realtor, FAR contract, is widely used throughout the state and the more recent versions do contain a reference to open permits. Many contracts contain an “As Is” rider which may relieve the Seller from any obligation to remedy open permits. Always review all contracts very carefully. Remember, as with a property inspection, a permit search may not be a contractual requirement but is prudent for all buyers particularly since Sellers may not be contractually obligated to close any open permits.
