Under certain circumstances, when the defendant has clearly demonstrated that he or she cannot be safely integrated in society, the judge should have the authority to determine that the defendant must be removed from society. at that point, it is not necessarily fair for society to maintian the defendant in a comfortable lifestyle, (I’m a firm believer in making inmates earn their keep – if that’s cruel and unusual punishment, then where do I complain – because I am forced to earn my keep and I haven’t committed any crimes) in those circumstances, the judge should declare that the defendant will not be leaving prison alive. the prisoner must work in some manner according to his abilities, in order to earn his heep, and may determine on his own behalf exactly how long he wants his stay in prison to be – again, keeping in mind he will not be leaving prison alive.
