Are home satellite services considered “personal wireless service”?
No. Section 704 of the 1996 Act specifically excludes “direct-to-home satellite services” from the definition of personal wireless services. State and local regulation of facilities used to receive these broadcast services is addressed under Section 207 of the 1996 Act. Pursuant to Section 207, the Commission has adopted rules concerning state, local, and private restrictions on viewers’ ability to receive video programming signals from direct broadcast satellites, multichannel multipoint distribution (wireless cable) providers, and television broadcast stations.
