Are FSTs an accurate at determining ones blood alcohol content?
Field sobriety tests cannot accurately gauge an individual’s blood alcohol content. It is well settled that FSTs are subjective and error prone. There are number of reasons that could cause a person to perform poorly on FSTs, including: being nervous, tired, pre-existing illnesses, physical disabilities, the defendant’s footwear, weather conditions, road conditions, age, weight, etc.
