Are ETSI standards, which are adopted before 8 April 2000 still applicable? Are Common Technical Regulations adopted under the previous Directive still applicable?
The Directive doesn’t change the status of ETSI standards. Standards are not adopted by the regulator but by ETSI, a recognised European standardisation organisation. Under the old Directive a number of ETSI standards were rendered obligatory through so-called Common Technical Regulations. Under the new Directive such standards will not further be obligatory. Where they however cover requirements, which are considered essential under the new Directive, they still retain a regulatory role. Products complying with these standards are presumed to conform to the Directive and meet the essential requirements. A large number of those standards however become superfluous.
